Why ESTATE PLANNING matters for your home!

Estate planning is essential for protecting your home and ensuring it is passed down clearly to your family. Without proper planning, inherited property can become heirs’ property, leading to unclear ownership, legal complications, and increased risk of tax issues or foreclosure. Planning ahead helps families avoid these challenges, maintain control of their property, and preserve generational wealth.

Wills

A Will is a legal document that outlines how your assets such as your home, money, and personal property will be distributed after your death. It also allows you to name an executor to carry out your wishes and can designate guardians for minor children. Without a will, Texas law determines who inherits your property, which may not reflect your intentions.

Transfer on death deeds

A Transfer on Death Deed (TODD) allows you to name a beneficiary who will automatically inherit your real property, such as your home, when you pass away without going through probate. You maintain full ownership during your lifetime, and the transfer only takes effect after death. This is one of the most effective tools for protecting heirs’ property and avoiding costly legal processes.

Power of Attorney (POA)

A Power of Attorney (POA) allows you to appoint a trusted person, your agent, to manage your financial and legal matters if you are unable to do so. This can include paying bills, managing property, or handling financial decisions. It can take effect immediately or only if you become incapacitated.
